Types and Causes of Massachusetts Birth Injuries

The most common birth injuries manifest themselves in the conditions known as Cerebral Palsy and Erb’s Palsy. These conditions most often occur as a result of complications during childbirth.

Cerebral Palsy

Cerebral palsy is commonly understood as a group of conditions which interfere with a person’s ability to move. Motor disorders usually manifest themselves during the first few years of a person’s life and continue over time. Some babies are born with the disorder, while others develop the condition shortly after birth. As a non-progressive condition, cerebral palsy does not get worse over time. Its symptoms, however, may change.

The typical effects of cerebral palsy for a baby are difficulties with sitting, crawling, walking, rolling over, speaking and even smiling. Cerebral palsy may also cause involuntary spasms, hearing and vision problems, and poor coordination. Adult individuals who suffer from cerebral palsy have difficulties with general motor tasks, such as using household appliances or writing. They usually are unable to drive a car or operate any machinery. Mental impairment and seizures are common side effects of cerebral palsy. Medical treatment, such as physical and occupational therapy, braces and some medicines, aid in the improvement of the quality of life of those who suffer from the condition. To date, there is no cure for cerebral palsy.

When damage occurs to the parts of the brain responsible for the control of limb coordination and muscle movement, cerebral palsy can occur. The severity of the condition varies, depending on the extent of the brain damage as well as which areas of the brain have been injured. The onset of the condition can be attributed to things which occur in the earliest stages of development in-utero, as well as during the delivery of the child, such as insufficient blood flow, infections, lack of oxygen, unrecognized genetic conditions and improper care during childbirth, as well as improper care post- delivery.

Erb’s Palsy

Erb’s Palsy, also known as Brachial Palsy, is a result of a nerve injury to the brachial plexus, the group of nerves in the shoulder which are responsible for sensations and motions of the arm, including the hand, fingers and wrists. The tearing or stretching of these nerves may result in the loss of ability to move the affected areas. Unlike Cerebral Palsy, Erb’s Palsy does not involve damage to the brain. Instead, it involves nerve damage. The condition is characterized by full or partial paralysis of the affected arm, diminished muscle control in the affected area and numbness in the arm or hand.

Erb’s Palsy usually occurs during a difficult delivery of a child, more specifically due to excessive pressure when pulling the child from the birth canal. Babies are at higher risk for Erb’s Palsy when they are larger than average, during prolonged labor or present in a breeched position. Although Erb’s Palsy is diagnosed at birth, the extent of the injury may not be fully apparent for some time.

The extent of the injuries of Erb’s Palsy varies from mild to severe, as do the treatments. For mild tearing of tissue, physical therapy and massage may help the baby heal on his or her own. Invasive operations such as transplants or nerve surgery may be required in cases of extensive nerve damage and do not guarantee a complete recovery.

Other Birth Injuries

There are several other types of birth injuries that can happen to your child or the child of someone you know that are less common, but just as heartbreaking. What follows is a list of other birth injuries that affect newborns as a result of a doctor’s carelessness or mistake.

  • Shoulder Dystocia – An obstetrical emergency which occurs during childbirth when, after the delivery of the head, the shoulders fail to deliver and need manipulation. Improper obstetrical responses to shoulder dystocia may result in physical complications to both the newborn and his or her mother.
  • Broken Bones and Fractures – Breaks in the continuity of the bone as a result of forceful impact during delivery.
  • Spinal Cord Injury – Injuries to the spinal cord that result from trauma rather than a disease.
  • Uterine Rupture – A break in the myometrial wall which can occur during vaginal childbirth. Uterine rupture occurs due to a scar from a prior Cesarean section that causes the subsequent child to become stuck in the mother’s abdominal cavity and lose access to oxygen.
  • Paralysis – The loss of function in one or more muscles. Paralysis is most often accompanied by sensory and motor damage.
  • Birth trauma – Bleeding in the brain (cephalohematoma) which can result from the improper use of forceps during delivery.

This list is not exhaustive of all potential birth injuries.

Your child should not have to suffer even the smallest of injuries due to negligent obstetric treatment. If your child suffers from any post childbirth injuries, call our office today to speak with one of our highly skilled Boston birth injury lawyers at 617-787-3700 or e-mail our Boston birth injury attorneys today at info@gilhoylaw.com.

What Causes a Birth Injury?

There are numerous tragic birth injuries that occur in Massachusetts every year. Although some may not be preventable, birth injuries occur far too frequently because of a failure to provide reasonable and appropriate care by the health care provider. What follows is a list of causes of birth injuries that may result from negligent medical care.

  • Delay in ordering a Cesarean Section - When a child is too large, or the birthing canal is too small, the safest way to deliver the baby is through a Cesarean section (or a C-section) delivery. Failure to order a timely C-section in an emergency situation may result in birth injuries or even fatalities.
  • Negligent use of forceps or extraction tools – In recent years, the number of deliveries with the use of forceps has been limited to situations where the head of the fetus is engaged, the cervix is completely dilated, and the fetal head is not too large to pass through the mother’s pelvis. Even in these situations, however, using too much force with the forceps or other extraction tools can result in bleeding and severe brain injuries. In many situations, the use of forceps for vaginal delivery poses a high risk of birth injuries and fetal mortality.
  • Umbilical cord entrapment – In approximately one out of every four births, the umbilical cord of the baby is wrapped around the neck just before or during the child’s birth. This does not usually pose a threat to the child. However, if the cord becomes wrapped too tightly, the baby will lose their oxygen supply and become at risk for serious birth injury or even death.
  • Failure to recognize or respond to bleeding – When vaginal bleeding occurs during labor or delivery, it is a warning sign. Something is wrong, and the baby must be delivered immediately. A doctor is responsible for noticing the bleeding and responding immediately and appropriately to this emergency situation. Failure to do so is medical negligence and can result in serious harm to both the baby and the mother.
  • Miscommunication between the doctor, nurse and/or patient – Medical health professionals are entrusted with the lives and well being of their patients on a daily basis and must take the utmost care to communicate accurate facts and circumstances when discussing a patient’s care with their colleagues and the patients themselves. A miscommunication in regards to the mother’s care during the pregnancy or the appropriate course of action during childbirth may lead to serious birth injury.
  • Negligent care following birth – Once the baby is born, the involved doctors and nurses must continue to provide the best care possible for the child. Failure to do so may escalate existing birth injuries or cause new and further harm to the child.
